This Privacy Policy governs the manner in which Sleep Outfitters collects, uses, shares, maintains and discloses information collected from users (each, a "User") of the www.SleepOutfitters.com website ("Site"). This privacy policy applies to the Site and all products and services offered by Sleep Outfitters.
BY ACCESSING ANY OF THE SITE OR PRODUCTS AND SERVICES OFFERED BY SLEEP OUTFITTERS, AND/OR BY OTHERWISE AGREEING TO THIS PRIVACY POLICY, YOU AGREE TO BE LEGALLY BOUND, AND TO ABIDE, BY THIS PRIVACY POLICY. PLEASE BE AWARE THAT THIS PRIVACY POLICY INCLUDES A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT TOGETHER WAIVE YOUR RIGHT TO A COURT HEARING AND JURY TRIAL.
Information we collect
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Site, register on the Site, place an order, subscribe to the newsletter, fill out a form and in connection with other activities, services, features or resources we make available on our Site. We may collect, monitor, and record information that you enter into a chat feature and search bar feature on the Services to provide you with information and support. Company takes records of actions you take while using our websites, apps, search bars, or other Services, including parts or all of your sessions our Services, information you submit on our Services, or communications or information sent through or using our Services may be collected, retained, and/or monitored by Us or by Our Service Providers and third-party partners. Any conversations via our chat functionalities may be retained by Sleep Outfitters and Service Providers for our business purposes.
By using the Services, you accept and consent to our collection of such data and to our sharing that data with our Service Providers.
We also use a website chatbot powered by Zoho Sales IQ to provide you with information and support. You acknowledge that our chat tool and Zoho Sales IT may collect, monitor, record, and manage any information (including personal data) that you enter certain device data and usage data gathered automatically. You further acknowledge and agree that by engaging with our Customer Service Team, we may record conversations for quality assurance and training purposes. These recordings will be made using the Ring Central platform. The collected data will be used to enhance our customer service experience and to efficiently resolve customer issues.
How we use collected information
Sleep Outfitters may collect and use Users’ information for the following purposes:

The information you provide helps us respond to your customer service requests and support needs more efficiently.
- To personalize User experience
We may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site, including which pages are most and least visited and how Users move around and interact with the Site.

We do not sell, trade or rent Users’ personal identification information to others. We may share aggregated demographic information not linked to any personal identification information regarding visitors and Users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

We may offer sweepstakes, contests, surveys and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your information, including Personal Information, may be disclosed to Company, co-sponsors, Service Providers, and other third parties, including for administrative purposes and as required by law (e.g., on a winners list). By entering, you are agreeing to the official rules that govern that Promotion, which may include consent to additional or differing data practices from those contained in this Privacy Policy. Although we do not “sell” “covered information” of Nevada “consumers” as those terms are defined by Chapter 603A of the Nevada Revised Statutes, you may contact us here and register an e-mail contact address for us to provide you notice in the event we should do so in the future, at which point you will have an opportunity to be verified and exercise your opt-out rights under that law. Contact us in the same manner to update your contact e-mail for notices. Changing your email elsewhere (e.g., informational requests, account information, etc.) will not update your Nevada notice contact information. It is your responsibility to keep your notice contact information current.

We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
Waiver of jury trial, binding arbitration and class action waiver
By using this Site and/or agreeing to this Privacy Policy, you agree that any and all claims, disputes, controversies, actions or proceedings relating to, or arising out of, your use of the Site and/or Sleep Outfitters’s products and services (collectively, “Claims”) shall be governed by the internal substantive laws of the state of Maryland without regard to its conflict of laws principles and that any and all Claims shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) or by a state small claims court of competent jurisdiction over the Claim and the parties.
You agree that: (i) any arbitration shall be conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by the AAA; (ii) any arbitration shall be conducted on submission, telephonically or at a reasonably convenient location; (iii) an arbitrator shall have the authority to award actual direct damages only, with no authority to issue any fines and penalties nor award punitive damages or equitable relief, and you may seek equitable relief from a court of competent jurisdiction at any time; (IV) EXCEPT AS SET FORTH IN SUBPART (VI) BELOW, THERE SHALL BE NO RIGHT TO LITIGATE YOUR CLAIM IN COURT AND NO RIGHT TO A JURY TRIAL; (V) YOUR CLAIM SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND YOU SHALL NOT HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION, AND THE ARBITRATOR SHALL HAVE NO AUTHORITY TO CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED AND MAY ONLY RESOLVE CLAIMS AND RENDER AWARDS BETWEEN YOU AND SLEEP OUTFITTERS ALONE; and (vi) you may elect to bring your claim in a state small claims court of competent jurisdiction over the claims and the parties. With the exception of subpart (v) above, if any part of this arbitration provision is deemed invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures of the AAA, then the same shall be stricken and the balance of this arbitration provision shall remain in effect and construed accordingly. Signing Up and Opting-In to the Service
Enrollment in the Service requires you to provide your mobile phone number and to agree to these Terms. You may not enroll if you are under 18 years old. Before the Service will start, you will need to agree to these Terms. Sleep Outfitters reserves the right to stop offering the Service at any time with or without notice.
By opting into the Service, you:
- Authorize Sleep Outfitters to use auto dialer or non-auto dialed technology to send recurring text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
- Acknowledge that you do not have to agree to receive messages as a condition of purchase.
- Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt-in.
- Consent to the use of an electronic record to document your opt-in. To request a free paper or email copy of the opt-in or to update our records with your contact information, please send an email to GuestSupport@SleepOutfitters.com. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access, and (ii) either a printer or storage space on such device. For an email copy, you'll also need an email account you can access from the device, along with a browser or other software that can display the emails.
Content You May Receive
Once you affirm your choice to opt-in to the SMS Service, your message frequency may vary. You may receive alerts about:

Once you affirm your choice to opt-in to receive order and shipping notifications, your message frequency may vary. You may receive the following updates about your order:
- When an order has been placed

Charges and Carriers
Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service.
Supported carriers are AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C Spire, MetroPCS and other smaller regional carriers. The Service may not be available on all wireless carriers. Sleep Outfitters may add or remove any wireless carrier from the Service at any time without notice. Sleep Outfitters and mobile carriers are not responsible for any undue delays, failure of delivery or errors in messages.
To Stop the Service
To stop receiving text messages from Sleep Outfitters, text the word STOP to 54609 any time or reply STOP to any of the text messages you have received from Sleep Outfitters. For Services operated through a different number, text STOP to that number to opt-out. Your opt-out request may generate either a confirmation text or a texted request to clarify the text message program to which it applies (if you have more than one). To complete your opt-out, please provide the requested clarification. You acknowledge that the text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that Sleep Outfitters and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from Sleep Outfitters through any other programs you have joined until you separately unsubscribe from those programs. These Terms still will apply if you withdraw the consent mentioned above or opt-out of the Service.
